The following are some of the issues that the WVTA attempted to get through the 2007 Legislative session. Things did not go as well as anticipated with some opposition from some of legislative body. This is the last week of the Legislative session and we will be able to provide further details following this week.

Legislative Issues

State Police Retirement System- (Plan B Improvements) SB335:

     This bill would have lowered the normal retirement age from the now mandatory age 55 to either age 52 or age 50 depending on years of service. This bill would also eliminate any reduction in the disability benefit for members disabled on the job.

On-Call Bill:

    This bill would have provided compensation to the members that were required to be on call to answer calls and provided the following language:

(a) Any time that the West Virginia State Police requires a State Police officer (inclusive of the ranks of Trooper to Sergeant) during their off-duty hours, is restricted as to where he or she may go, what he or she may do in order that he or she may quickly return to duty, the officer shall be paid the minimum wage as determined in section one, Article Fifteen-C, Chapter Two of this code for every hour which he or she is on call. This code section pertains to non-exempt state police officers as defined under the Fair Labor Standards Act (FLSA). This pay is not subject to retirement deduction or used in retirement annuity calculations.

(b) State Police officers who are off-duty and called back to work by the West Virginia State Police or required to appear in court, shall be guaranteed a
minimum of two hours work or actual hours worked, whichever is greater.

Leave Donation:

   This issue was to provide the President of the WV Troopers Association to receive leave donation to allow the President the proper time needed to address the issues of the membership with the Legislative body. This issue did not even make it to bill status.
