CLASS ACTION UPDATE

There was a hearing held on the class action suit before Judge Kaufman on Tuesday.  Judge Kaufman did not make a decision.  He indicated that he is going to take it under advisement, review the extensive record (which is hundreds of pages long), and get a decision out as soon as he reasonably can.  After that, if he should rule for us, then the Board would have a right to appeal to the Supreme Court.  Likewise, of course, if he rules against us, then we have a right to appeal to the Supreme Court. 

Keep in mind that we also have the class action pending in the Circuit Court of Kanawha County in front of a different judge, Judge Stucky.  The decision on the administrative appeal before Judge Kaufman may or may not have any affect on the class action one way or the other.
